The Japanese have a pretty good grasp of the difference between
fantasy and reality (United States does NOT, btw). Hentai and Manga
do not actually involve a child, hence there is no victim. It
essentially becomes a thought crime to convict someone of that.
Real child porn involved an actual child at some point. So an
actual victim. Japan's laws didn't make possession illegal at
first because the people having photos or whatever didn't actually
commit the crime of abusing or exploiting the child. This made
sense to a point: for instance you wouldn't convict a person of
murder if they downloaded a picture of someone that had been shot,
right? No, that's just silly. However, this makes a market for the
child porn, and therefore encourages more victims to keep the
pictures/videos being produced. So they made possession illegal to
curb the demand, which was fueling actual crimes. They didn't
include hentai/manga because no amount of demand for it will
ever cause an actual child to be a victim in order to produce that
hentai/manga. So not illegal in Japan.
