As it as been mentioned already in this thread the Auto TK system doesn't see reason it only see's damage inflicted.
However, in cases like you experienced it is wise to let it happen and let the correct party receive the fine instead of yourself.
No matter how much it angers you and I dare say all of us, another thing to do is watch what happens and record a replay. If then the TK'er isn't dealt with properly,
Send a ticket to support along with the replay and let them sort it out.
