From my testing (with the Rudy just to be sure) I can't even get the option to spend Free XP if I have combat exp on it, and upgrading definitely uses the combat XP (my free XP total didn't change).
I'm not sure how this action looks in the invoice logs yet but it's definitely worth submitting a customer support ticket so they can take a look and see if there's a bug happening.
