It has been used since the cold war but with different colours. One of the already existing camouflages already have the right sets of colours, but the shapes are all wrong. They are supposed to be straight lines making irregular shapes. Due to the irregular and non-repeating pattern of M90 it cannon be copyrighted, so there would be no legal issue with you putting it in the game.
