The_Chieftain: It will be entertaining, for sure, not least as someone with a law degree who takes odd interest in such things, but I am far from convinced that he will lose. EO #2 was written while actually consulting with lawyers this time, and the judiciary are not a united block. Although the appeals process from EO #1 was abandoned as a result of the decision to go with EO #2, a number of 9th Circuit judges took the rather unusual step of filing a dissent anyway despite not being called upon to analyse it.
